<p><strong>What is a stock loan?</strong><br />
Non-recourse Stock Loans by definition are loans against the value of  a stock or portfolio of stocks, bonds, mutual funds, t-bills, whereby  the owner can borrow in some cases up to 90% of the stock value or the  portfolio&#8217;s market value &#8220;without selling the shares&#8221;.  Like a home  equity loan for stocks but much better, because you borrow against the  value of the portfolio, pay a below prime fixed interest rate for the  term of the loan. (Adjustable rates are also available) . At the term  end you either pay off the loan, refinance, or renew the loan.</p>
<p><strong>What stocks are eligible for a Stock Loan?</strong><br />
Any publicly traded security is eligible. Stocks, bonds, mutual  funds, <strong>ETF&#8217;s</strong> (exchange traded funds) <strong>ADR&#8217;s</strong> (American Depository  Receipt). 			<content:encoded><![CDATA[<p>Four defendants Jeffrey Todd Crandell, 32, of Gilbert, Ariz., Jake  David Abegg Whitman, 33, of Gilbert, Ariz., Frederic Charles Crum, 37,  of Gilbert, Ariz., and Tyson Kent Young, 30, of San Tan Valley,  Ariz were sentenced on March 26, 2010, by U.S. District Judge G. Murray  Snow for their respective roles in a multi-million dollar mortgage  fraud scheme.</p>
<p>&#8220;These prosecutions assist in demanding accountability from an adrift  mortgage industry, which caused great stress to our economy,&#8221; said  Dennis K. Burke, U.S. Attorney for the District of Arizona. &#8220;We are  grateful to the FBI-led Mortgage Fraud Task Force that continues to  investigate these matters.&#8221;</p>
<p>Crandell and Whitman were the leaders of the scheme. In 2005, they  obtained the rights to various parcels of real estate located in  Chandler, Gilbert, and Queen Creek, Ariz., obscured their interest in  those properties by placing them in the name of relatives or in  corporate shells, and then recruited friends and acquaintances to buy  the properties for inflated prices often hundreds of thousands of  dollars more than the cost of the land. Crandell or Whitman also acted  as the mortgage broker in most of the transactions. In that capacity,  they were responsible for preparing the buyer&#8217;s loan applications. They  included multiple lies in the applications in order to persuade the  lender to approve the loans. Among other things, they inflated the  buyers incomes and assets and stated falsely that the buyers would be  making the down payment. In fact, at closing, Crandell or Whitman would  supply the down payment on behalf of the buyer and also provide a cash  kickback to the buyer. All told, this scheme caused federally-insured  banks to provide more than $6 million in loans and to suffer more than  $1 million in losses after the properties fell into foreclosure.</p>
<p>The remaining defendants played supporting roles in the conspiracy.  Crum acted as the mortgage broker for three properties and, in that  capacity, prepared false loan applications and created doctored  financial statements that overstated the buyer&#8217;s assets. Young agreed to  pose as the owner of several properties in order to obscure Crandell&#8217;s  interest.</p>
<p>Judge Snow sentenced the two leaders of the conspiracy, Crandell and  Whitman, to 62 months imprisonment and 10 months imprisonment,  respectively, with Whitman receiving a lesser sentence due to his early  guilty plea and cooperation with the prosecution. Meanwhile, Crum  received a sentence of four months imprisonment and Young received  deferred prosecution. (One remaining defendant, Erin Michelle Leastman,  28, of Gilbert, Ariz., is scheduled to be sentenced on April 1, 2010.  Leastman acted as the escrow agent in all but one of the transactions.)</p>
<p>This prosecution is part of an initiative called &#8220;Operation Cash  Back&#8221; in which dozens of defendants including many real estate  professionals were indicted between 2007 and 2009. To date, 49 have been  convicted through guilty pleas or following trial.</p>
<p>Operation Cash Back is part of a nationwide initiative under the  Financial Fraud Enforcement Task Force established by President Obama.  In Arizona, Operation Cash Back represents the efforts of the U.S.  Attorney&#8217;s Office, FBI, Internal Revenue Service-Criminal Investigation  Division, U.S. Immigration and Customs Enforcement, Department of  Housing and Urban Development Office of the Inspector General, U.S.  Marshals Service, U.S. Postal Inspection Service, U.S. Secret Service,  the FDIC-OIG, Arizona Department of Financial Institutions, Arizona  Attorney General&#8217;s Office, county attorneys and local police  departments.</p>
<p>The investigation in this case was conducted by the Federal Bureau of  Investigation. The prosecution was being handled by Dominic Lanza,  Raymond Woo, and Kevin Rapp, Assistant U.S. Attorneys, District of  Arizona, Phoenix.</p>

Burke announced a federal grand jury in  Tucson returned a six-count indictment against Scott Tyson, age 43, and  Susan Levy, age 69, of Tucson, Arizona. The indictment charges the  defendants with wire fraud and conspiracy to commit wire fraud.</p>
<p>According to the indictment, Levy, a licensed Arizona real estate  agent, received approximately $1.2 million dollars in loans to purchase  multiple real estate properties between February, 2006 and July, 2007.  In obtaining her loans, Levy failed to disclose that she had purchased  other properties during this time period and/or understated her  liabilities, thus constituting a material omission of fact submitted to  the lenders. Scott Tyson was the loan officer used by Levy in each of  these transactions.</p>
<p>&#8220;The defendants conspired to obtain multiple mortgages based upon  fraudulent representations. The goal of the conspiracy was to profit  from either the commissions received from the loans or the future sale  of the properties or <strong>flip</strong>,&#8221; said U.S. Attorney Dennis K. Burke. &#8220;This  office is dedicated to prosecuting mortgage fraud related offenses and  this indictment is another example of our partnership with the FBI to  prosecute and hold industry insiders accountable.&#8221;</p>
<p>An indictment is simply the method by which a person is charged with  criminal activity and raises no inference of guilt. An individual is  presumed innocent until competent evidence is presented to a jury that  establishes guilt beyond a reasonable doubt.</p>
<p>&#8220;Arizona has been greatly impacted by all facets of mortgage fraud in  the last few years,&#8221; said FBI Special Agent in Charge Nate Gray. &#8220;The  indictment of Tyson and Levy illustrates the FBI&#8217;s commitment to  investigate those within the mortgage industry who allegedly conspired  to profit from mortgage fraud. The FBI will continue to make mortgage  fraud a priority and will pursue those who participate in various  mortgage fraud schemes.&#8221;</p>
<p>A conviction for conspiracy to commit wire fraud and wire fraud  carries a maximum penalty of 20 years imprisonment, a $250,000 fine or  both for each count. In determining the actual sentence, the judge will  consult the U.S. Sentencing Guidelines, which provide appropriate  sentencing ranges. The judge, however, is not bound by those guidelines  in determining a sentence.</p>
<p>The investigation preceding the Indictment was conducted by the  Federal Bureau of Investigation&#8217;s Mortgage Fraud Task Force. The  prosecution is being handled by Assistant U.S. Attorney Jonathan Granoff  of the U.S. Attorney&#8217;s Office for the District of Arizona in Tucson.</p>

On Monday, Punjab National Bank, Allahabad Bank and United Bank had raised their base rates and benchmark prime lending rates (BPLR).</p>
<p>OBC  has revised its base rate upwards by 50 basis points to 9.50% and BPLR  by 50 basis points to 13.75%. Dena Bank, IOB and Indian Bank have hiked  their base rates by 50 basis points.</p>
<p>Nupur Mitra, ED, IOB said, &#8220;The demand for credit is unlikely to be impacted by higher rates and we  will be taking a call on whether to hike the BPLR, which is currently  at 13.5%. However, our margins are likely to suffer as a result and  could drop to 3% from 3.27%.&#8221; With the latest round of loan rate hikes,  the base rates of almost all banks are now above 9%. <p>&#8220;This  is line with the interest rates in the economy, which have hardened due  to an increase in policy rates, inflation and liquidity in the domestic  market,&#8221; HDFC said in a release. HDFC has increased its retail prime lending rate (RPLR) to which its  Adjustable rate home loans (ARHL) is benchmarked, by 25 basis points.  The RPLR for loans up to Rs 30 lakh will be 9.75%, for loans between Rs  30 lakh and Rs 75 lakh will be 10% and for loans above that it will be  10.5%.</p>
<p>Meanwhile, Bank of Baroda has realigned deposit rates reducing them for some buckets while increasing them for others.</p>
<p>On  Monday, Punjab National Bank had upped both its base rate and benchmark  prime lending rate by 50 basis points each to 9.5%and 13% respectively.</p>
<p>It  was the first bank to hike loan rates after the Reserve Bank of India  (RBI) hiked key policy rates by 25 basis points each on January 25,  2011, during its review of the monetary policy.</p>
<p>Said KR Kamath,  CMD, PNB, &#8221; We believe that credit offtake will not be impacted by the  increase in the loan rates. We have increased deposit rates because we  need to sustain both the growth in deposit, currently at 20% and  maintain credit growth at 25%.&#8221;</p>
<p>Kamath added that the hike was  taken in response to the Reserve Bank of India&#8217;s (RBI) wishes that  credit and deposit growth be aligned.</p>
<p>Allahabad Bank increased its  BPLR by 25 basis points to 13.50% and its base rate by 50 basis point  to 9.50%. United Bank of India(UBI) too upped its base rate by 50 basis  points to 9.45% and BPLR by 50 bps to 13.50%.</p>
<p>With wholesale  inflation ruling at 8.5% for the better part of 2010, the central bank  increased policy rates six times between March and December 2010.</p>
<p>Banks  followed suit increasing both loan and deposit rates with some lenders  such as ICICI Bank upping rates twice in the span of a month. The latest  hike by banks was on December 31, 2010, when five banks including State  Bank of India (SBI)  upped loan rates. While SBI raised its base rate by 40 basis points to  8%, ICICI Bank hiked its base rate and benchmark prime lending rate  (BPLR) by 50 basis points to 8.25% and 25 basis points to 17%,  respectively.</p>

<p>A sale is only &#8220;cemented&#8221; when the seller and the lender are in  complete agreement, and when all the paperwork is properly completed. An  approval will be valid for only a certain amount of time and money,  even if the buyer is serious of purchasing the property in spite of  having the funds.</p>
<p>There is the little difference; an approval means that your request  for a property loan has been finalized. A qualification means that you  have passed the request stage and now quality for a property loan. Everything you tell them will be verified by your bank and  your references and employers, which is why it&#8217;s important to be precise  and to tell the truth on the application.</p>
